Terms and Conditions
,
SUBJECT
These terms and conditions of sale apply to all services and products offered on azur-parapente.fr. Their purpose is to set out the terms and conditions under which Thierry DELORME, Azur Parapente, provides services to clients. They take effect as soon as an order is confirmed on our website or by our office.
Documents (descriptions, technical specifications, photos, etc.) are provided for information purposes only and will be followed as closely as possible. The practice of aerial sports depends on external conditions, which only the pilot can assess. In the event of dangerous or unsuitable conditions, the activity may be cancelled at launch (a rare occurrence). The provider cannot be held liable for cancellations for these reasons.
FORMATION OF THE CONTRACT
Departures:
- Client: person who has purchased the service.
- Recipient: the person receiving the service, who may also be the customer.
- Service provider: company or self-employed professional responsible for delivering the activity.
Every order, whether paid online or by phone, commits the customer. After payment, an acknowledgement of receipt, a PDF voucher or ticket, and an invoice will be sent. Placing an order implies acceptance of the terms and conditions, which the customer acknowledges having read.
SERVICES OFFERED
Thierry DELORME, via azur-parapente.fr, offers gift vouchers and a booking service for tandem paragliding flights in Roquebrune-Cap-Martin with his team of instructors. Any order for a gift voucher or ticket, confirmed by an email with an invoice and a copy of the Terms and Conditions, is considered final.
OFFER VALIDITY
Offers are subject to availability at the time of booking. For gift voucher bookings, the validity period is always stated on the voucher: one year from the date of purchase. The activity must take place within this period, between October and April. We recommend booking at least one month before the expiry date to allow for a possible weather-related reschedule.
No refund will be issued for any activity that is interrupted or not used by the beneficiary. Bookings not cancelled at least 48 hours in advance remain payable, and no refund will be given. The client is responsible for making an appointment within the validity period. The service provider cannot be held liable if an appointment is made too late or if the service cannot be performed due to unfavourable flying conditions.
PRICES AND PAYMENT TERMS
Prices are quoted in euros, inclusive of all taxes (TTC), and are those in effect at the time of the order. An order is considered firm and final once the customer confirms their purchase by clicking the “Book” or “Buy” button. The booking is confirmed only after full payment has been received, as confirmed by an acknowledgment of receipt and proof of payment issued by YoPlanning.
Payment can be made by credit card via the secure Stripe platform by entering the card number, expiry date and security code. The transaction is only considered complete once approved by the payment centre, and our website does not retain any banking information. Payment can also be made by bank transfer to the account specified on the invoice.
An invoice or proof of payment marked “paid in full” will be provided on request. If the payment is declined or unsuccessful, the booking will not be considered confirmed, and no service will be provided. The service provider shall not be held liable if the order is not processed for this reason.
The client is informed that prices may be subject to change, particularly in the event of cost fluctuations or price changes, provided they are notified in advance. The service provider cannot be held liable for any delay or failure to process the order resulting from an error or invalidation of the payment.
Personal data relating to payment is processed in accordance with our Privacy Policy, available on our website, and in compliance with the GDPR.
PASSENGER HEALTH/WEIGHT INFORMATION.
When booking or purchasing a paragliding flight, the customer must provide accurate information about their physical condition, health and weight to ensure the flight is feasible and safe. They confirm that they are in good physical health, fit to take part in an aerial sporting activity, and have no medical conditions that would prevent them from paragliding.
Passengers must weigh between 20 kg and 80 kg to take part in a tandem flight. Passengers weighing over 80 kg must first undergo an assessment of their physical fitness. Only customers in good physical condition, able to run actively for approximately 20 metres alongside the instructor during take-off, may participate in the flight.
The client is responsible for providing truthful and accurate information about their weight, health and ability to take part in the activity. The feasibility of the flight, including whether it is safe to take off and land, is assessed on site by the supervising staff or pilot, who alone is qualified to determine whether the client’s physical condition allows them to fly. In case of doubt, or if the client does not meet these requirements, the service provider reserves the right to refuse participation, without any entitlement to a refund or compensation.
The client acknowledges having been informed that paragliding involves risks and that they take part at their own risk, carefully following the instructor’s directions. They agree that the supervising staff will make the final decision on whether or not the flight can go ahead, based on an assessment of their physical condition and the weather at the time.
MEETING ARRANGEMENTS
The appointment and flight feasibility are confirmed the day before, from 6:00 pm, once the weather forecast has been checked. On the day of the appointment, clients must arrive at the indicated location 15 minutes early: 13 Avenue le Corbusier, 06190 Roquebrune-Cap-Martin. They must bring their booking voucher, wear suitable clothing and follow the safety instructions.
GIFT VOUCHER
Customers can purchase a gift voucher by phone by calling 06 80 13 59 15, or directly on the website azur-parapente.fr. Gift vouchers are valid for one year and give access to a full flying season from October to April. This flexibility allows recipients to contact us later to suggest dates for their flight. If you’d like to paraglide on a specific date, we recommend calling us in advance to check availability. Anyone holding (or having purchased) a gift voucher or ticket has proof of payment that can be used with Azur Parapente to take part in the activities on offer. These vouchers are not issued in a specific name and state the service and package selected.
Gift vouchers are not issued in a specific person’s name and can be transferred to someone else, provided they meet the eligibility criteria (weight, health). The recipient must book at least one month before the voucher expires to allow for rescheduling if the weather is unfavorable or something unexpected comes up.
The customer or beneficiary is responsible for meeting these deadlines to ensure the activity can take place or to arrange a rescheduling if necessary.
CANCELLATIONS, RESCHEDULING AND WEATHER CONDITIONS
The provider, Thierry DELORME – Azur Parapente, has sole discretion to decide whether to cancel or reschedule due to weather or safety concerns. In the event of unsuitable conditions, the activity will be rescheduled for a later date, subject to availability. No refunds are available for cancellations or rescheduling for these reasons, except in cases of serious misconduct or negligence on the part of the provider. The customer may not cancel or change the booking themselves less than 48 hours before the meeting time: this decision rests solely with the provider. Any attempt to cancel within this period without approval will be considered invalid, and the booking will remain payable.
RIGHT OF WITHDRAWAL
In accordance with the provisions of the Consumer Code (Article L221-18 et seq.), the client has fourteen (14) calendar days from the conclusion of the contract to exercise their right of withdrawal, without having to give a reason or pay a penalty, unless the service has begun with the client’s express consent before the end of this period.
This right of withdrawal applies only if the order was placed remotely, online or by phone, and the service has not begun before the withdrawal period expires, with the customer’s consent. If the customer has agreed to start the service during this period, the right of withdrawal may be limited or excluded in accordance with Article L221-28 of the French Consumer Code.
This clause does not apply to appointments.
To exercise this right, the customer must notify us of their decision in a clear statement, sent by registered mail with acknowledgment of receipt to the following address: 228 Avenue Gustave Charpentier, 83370 Saint Aygulf, or by email to thierry@azur-parapente.fr, before the 14-day period expires.
If the client exercises their right of withdrawal, the service provider will refund all sums paid within a maximum of 14 days of receiving the request, using the same payment method as for the order, unless the client agrees otherwise.
WARRANTIES AND INSURANCE
The service provider holds the mandatory and supplementary insurance cover required by law for its activities. Details of this cover are available online at azur-parapente.fr and ffvl.fr. Customers and passengers are responsible for checking that their own insurance cover is adequate. If in doubt, they should take out additional insurance. The service provider accepts no liability if this check is not carried out.
