OBJECT

These general terms and conditions of sale apply to all services and products offered on the azur-parapente.fr website. Their purpose is to define the terms and conditions under which Thierry DELORME, Azur Parapente, offers its services to customers. They come into effect as soon as an order is validated on our website or by our office.

The documents (descriptions, technical data sheets, photos, etc.) are provided for information purposes only and are respected as much as possible. The practice of aerial sports leisure depends on external conditions, which only the pilot can interpret. In the event of dangerous or inappropriate conditions, the service may be canceled at the start (rare case). The service provider cannot be held liable in the event of cancellation for these reasons.


FORMATION OF THE CONTRACT

Parties :

  • Client: person who purchased the service.
  • Beneficiary: person benefiting from the service, who may also be the customer.
  • Service provider: company or independent contractor responsible for carrying out the activity.

Any order, paid online or by phone, is binding on the customer. After payment, an acknowledgment of receipt, a PDF receipt or ticket, and an invoice will be sent. The order implies acceptance of the General Terms and Conditions, which the customer acknowledges having read.


SERVICES OFFERED

Thierry Delorme, via azur-parapente.fr, offers gift vouchers and a booking service for tandem paragliding flights in Roquebrune-Cap-Martin with his team of instructors. Any gift voucher or ticket order, confirmed by an email with an invoice and a copy of the Terms and Conditions, is considered final.


VALIDITY OF THE OFFER

Offers are subject to availability at the time of registration. For a gift voucher reservation, the validity period is always indicated on the voucher: one year after the purchase date. The service must be completed during this period, between October and April. It is recommended to book at least one month before the validity period expires to allow for possible weather delays.

Any activity interrupted or not consumed by the beneficiary does not give rise to any refund. Reservations not canceled 48 hours in advance remain due, no refund is provided. The client is responsible for making an appointment within the validity period. The service provider cannot be held liable in the event of late appointments or the impossibility of providing the service due to unfavorable weather conditions.


PRICE AND PAYMENT TERMS

Current prices are indicated in euros, all taxes included (TTC), and are those in effect at the time of the order. The order is considered firm and final as soon as the customer confirms their purchase by clicking on the "Reserve" or "Buy" button. The reservation is only effective after receipt of full payment, confirmed by the issuance of an acknowledgment of receipt and a payment certificate by YoPlanning.

Payment can be made by credit card via the secure Stripe platform, specifying the card number, expiration date, and cryptogram. The transaction is considered validated only after approval from the payment center, and no banking data is stored by our site. Payment can also be made by bank transfer to the account indicated on the invoice.

An invoice or proof of payment, stating "payment received," will be issued upon request. In the event of invalidation or failure of payment, the reservation will not be considered confirmed, and no service will be provided. The service provider cannot be held liable in the event of non-processing of the order for this reason.

The customer is informed that the price may be subject to change, particularly in the event of cost fluctuations or price changes, subject to prior notification. The service provider cannot be held liable in the event of a delay or failure in processing the order due to an error or invalidation of the payment.

The processing of personal data related to payment is carried out in accordance with our Privacy Policy, accessible on our website, and in compliance with the GDPR.


INFORMATION Health/Weight of passengers.

The customer, when booking or purchasing a paragliding flight, is informed that he must have precise knowledge of his physical condition, his state of health, as well as his weight, in order to guarantee the feasibility and safety of the flight. He guarantees that he is in good physical health, able to participate in an aerial sport activity, and that he does not have any medical contraindications to the practice of paragliding.

Passengers must weigh between 20 kg and 80 kg to participate in the tandem flight. Passengers weighing between 80 kg and over require a prior fitness assessment. Only customers in good physical condition, able to actively run a distance of approximately 20 meters with the instructor during takeoff, will be permitted to participate in the flight.

It is the customer's responsibility to provide truthful and accurate information regarding their weight, health, and ability to participate in the activity. The feasibility of the flight, including the ability to take off and land safely, is assessed by the supervisory staff or the pilot on site, who alone is authorized to judge whether the customer's physical condition allows the flight to take place. In case of doubt or if the customer does not meet these conditions, the service provider reserves the right to refuse participation, without this giving rise to a right to reimbursement or compensation.

The client declares that he/she has been informed that paragliding involves risks and that he/she participates at his/her own risk, scrupulously respecting the instructor's instructions. He/she accepts that the final decision on whether or not to carry out the flight will be communicated to him/her by the supervising staff, based on the assessment of his/her physical condition and the weather conditions at the time.


ORGANIZATION OF THE MEETING

Confirmation of the appointment and flight feasibility are made the day before, from 6:00 p.m., after checking the weather forecast. On the day of the appointment, the customer must arrive 15 minutes before at the indicated location: 13 Avenue le Corbusier, 06190 Roquebrune-Cap-Martin. They must bring the booking voucher, wear suitable clothing, and follow the safety instructions.


GIFT CERTIFICATE

The customer can purchase a gift voucher either by phone by calling: 06 80 13 59 15, or directly on the website azur-parapente.fr. Gift vouchers are valid for one year and give access to a full flying season from October to April. This flexibility allows the recipient to contact us later to suggest practice dates. If the customer wishes to take their paragliding flight on a specific date, it is advisable to call us in advance to check our availability. Any holder (buyer) of a gift voucher or ticket has proof of payment to Azur Parapente, allowing them to carry out the proposed activities. These vouchers are not nominative and specify the service and the chosen formula.

Gift vouchers are not nominative and may be transferred to another person, provided that acceptance criteria (weight and health) are met. The recipient must book at least one month before the voucher's expiry date to allow for possible rescheduling in the event of adverse weather or unforeseen circumstances.

The client or beneficiary is responsible for respecting these deadlines to ensure the activity is carried out or to organize a postponement if necessary.


CANCELLATION, POSTPONEMENT AND WEATHER CONDITIONS

The service provider, Thierry DELORME – Azur Parapente, is the sole judge of cancellation or postponement due to weather or safety concerns. In the event of poor weather conditions, the service will be postponed to a later date, subject to availability. No refund is provided for cancellation or postponement for these reasons, except in the event of serious misconduct or negligence on the part of the service provider. The client cannot cancel or modify the reservation themselves less than 48 hours before the appointment: this decision rests exclusively with the service provider. Any attempt to cancel within this period without agreement will be considered invalid, and the reservation will remain due.


RIGHT OF WITHDRAWAL

In accordance with the provisions of the Consumer Code (article L221-18 et seq.), the customer has a period of fourteen (14) calendar days from the conclusion of the contract to exercise his right of withdrawal, without having to provide a reason or pay a penalty, unless the service has begun with the express agreement of the customer before the end of this period.

This right of withdrawal only applies if the order was placed remotely, via the internet or by telephone, and the service has not started before the expiry of the deadline, with the customer's agreement. If the customer has given their agreement to start the service within this period, the right of withdrawal may be limited or excluded in accordance with Article L221-28 of the Consumer Code.

This clause does not apply to appointments.

To exercise this right, the client must notify their decision by a clear statement, sent by registered letter with acknowledgment of receipt to the following address: 228 Avenue Gustave Charpentier, 83370 Saint Aygulf, or by email to thierry@azur-parapente.fr, before the expiry of the 14-day period.

In the event of exercising the right of withdrawal, the service provider will reimburse the customer for all sums paid, within a maximum period of 14 days from receipt of the request, using the same means of payment as that used when ordering, unless otherwise agreed by the customer.


GUARANTEES AND INSURANCES

The service provider has the mandatory and additional regulatory guarantees for its activities. These guarantees can be viewed online at azur-parapente.fr and ffvl.fr. It is the customer's or passenger's responsibility to verify that their own insurance coverage is sufficient. If in doubt, they must take out additional insurance. The service provider cannot be held liable for failure to comply with this verification.


INTELLECTUAL PROPERTY

The logos, trademarks, and designs on this site are the property of Thierry DELORME. Any reproduction or use without authorization is prohibited.


CLAIMS AND MEDIATION

Any complaint must be sent by registered letter to: Azur Parapente, 228 Avenue Gustave Charpentier, 83370 Saint Aygulf, within 15 days of the service, with supporting documents. In the event of a dispute, the customer must seek an amicable solution. Failing this, they can contact the consumer mediator free of charge via:

APPLICABLE LAW AND JURISDICTION

The General Terms and Conditions are governed by French law. In the event of a dispute, the French courts, in particular those within the jurisdiction of the registered office at 228 Avenue Gustave Charpentier, 83370 Saint Aygulf, shall have exclusive jurisdiction. The customer may also resort to mediation before any legal action.


PROTECTION OF PERSONAL DATA

The data collected during the reservation or purchase process is necessary for contract management. It is treated confidentially and is intended for Azur Parapente, its partners, and insurers. In accordance with the GDPR, the customer has the right to access, rectify, delete, oppose, transfer, and limit data processing. They can exercise these rights by contacting thierry@azur-parapente.fr or by mail to the head office address. A privacy policy is available on our website.


IMAGE RIGHTS and use of communication media

The client expressly authorizes Azur Parapente to use, free of charge, all photographs and videos taken during the services, in particular those representing the client in activity or during the use of its services, for the communication of the activity on the website azur-parapente.fr, its social networks, as well as on any other communication media (brochures, newsletters, advertising media, etc.).

The client declares that he/she has been informed that these materials may be distributed for promotional purposes, to promote the activity, or for institutional purposes. He/she guarantees that these images do not infringe on his/her privacy or rights, and that he/she holds all necessary authorizations for their use.

The customer has a right of withdrawal, which he can exercise at any time by sending a written request to Azur Parapente at the following address: 228 Avenue Gustave Charpentier, 83370 Saint Aygulf, or by email to thierry@azur-parapente.fr. Upon receipt of this request, Azur Parapente undertakes to cease all use of the images concerned within a reasonable period of time.
